1. Introduction

Please read these terms and conditions carefully before accessing or ordering any products from Vape Stop™ website. Accessing, browsing or using this website in any way indicates that you agree to be bound by these terms and conditions. If you do not agree to any of these terms, you must not use our website or products. We reserve the right to amend these terms & conditions at any time without notifying our customers. The terms of conditions also include Privacy Policy and Cookies Policy. Your consent to website and product usage is your acceptance to these policies as well. It is your responsibility to review these terms and conditions on a regular basis to keep informed of any modifications or changes.

2. Age Restriction and Verification

The website is meant for adult smokers of the age of 18 or above in Bangladesh. To prevent underage sales, we may physically verify the age of the buyer at the time of final delivery before the shipment is released, via a signature and a valid government id consisting of any country passport, or any country driving license. The name of the ‘ship to’ person should match with the id and the person collecting the shipment. In case of any name mismatch or in case of underage id, the order will be cancelled and returned back to Vape Stop. The id soft copy will be stored in a secure database, and will never be used for any other purpose other than for keeping record of delivery to 18+ year olds.

3. Product Warning and Usage

The following 6 points are also part of our communication policy, and should be read carefully:

• Vape Stop products are not for use by non-users of tobacco or nicotine. Products are for those adults who cannot quit or will not quit consuming tobacco or nicotine.
• Cigarette smoking is highly addictive and seriously harms one’s health. The ultimate aim and the best solution is to neither smoke nor vape.
• Vape Stop products are not meant for those adult users who would otherwise quit using tobacco or nicotine products.
• Vape Stop products are not an alternative to quitting, and are not sold or marketed as cessation or medical tool. Products are not for use by people with heart conditions, diabetics, and pregnant or breast-feeding women.
• Vape Stop products are not risk free and contain nicotine which is highly addictive. However, ENDS have been found by select credible organizations in UK to be of comparatively lesser harm than combustible cigarettes.
• Minors under 18 years of age should never consumer tobacco or nicotine products in any form. We have a robust and seamless age verification system wherein the age and name is verified through a valid government id at the time of final delivery before shipment release.

Additional Product Related Points:

• All product imagery is for illustrative purpose and minor variances may exist between photos and the actual item (e.g. colour, shape or design of e-cigarette, cartridges or e-liquid bottles).
• Once purchased, the products on this website should only be used in accordance with the brand or manufacturers' instructions and should be inspected before use and properly maintained. Vape Stop is not liable for any information or misinformation provided by the manufacturer or brand.

4. Free Return Within 15 Days

If for any reason you would like to return the item purchased within a period of 15 dates from the date of purchase, please inform us and we will issue you a full refund. The refund will be issued for sealed items which upon physical inspection are found to be of the same brand new condition. Refunds will not be issued for items that have been opened or used, and will only be issued for the amount of the actual product excluding any shipping charges. In case of a manufacturing defect, refund or replacement will be provided.

5. Warranty

All Vape Stop products have a 60-day full manufacturing warranty, with the exception of tanks, coils and e liquids. For select products, the brands themselves provide a longer warranty period of up to 1 year from purchase. In case customers would like to avail such an extended warranty, they are free to reach out to Vape Stop and we can then facilitate the refund or replacement directly from the brand after the initial 60-day period of purchase, beyond which receiving the refund or replacement is dependent on the brand under consideration. Manufacturing defects only are covered in the warranty, and issues related to abuse, misuse or normal wear & tear including exposure to humidity or heat are not covered in the warranty. Upon inspection, if the product is found to be defective, we will ship you a replacement item. Please contact our customer service team for next steps if your product has a manufacturing defect.

6. Shipping and Delivery

Orders placed before 12pm on working days’ qualify for same day delivery in Dhaka. For orders placed after 12pm on a working day, delivery will be done the following working day. For orders placed outside of Dhaka, delivery will be done the following working day. All deliveries are within the country of Bangladesh. We cannot deliver via Vape Stop Bangladesh to any other country. Exceptional circumstances such as technical difficulty, natural calamities such as severe rain, and excessive traffic etc. may result in delayed delivery.

7. Incorrect Delivery Address

It is the responsibility of the customer to enter the correct delivery address for products. The name of the billing and the consignee or ‘ship to’ person, and the person accepting the final delivery must match. If you have entered an incorrect mailing address, then please get back to us as soon as possible, and if the package has not left for delivery, we will edit the mailing address.

8. Limitation Of Liability

Vape Stop is not liable to any loss or damage caused wholly or mainly by your breach of our Terms & Conditions. We hereby disclaim any and all liability for personal injury, product defect and/ or failure, claims that arise that are due to normal usage, misuse of products, abuse of products, product modifications, improper product selection since Vape Stop is just an aggregator of various brands available for sale. For any liability arising due to product usage etc., please read the terms and conditions or any liability policy from each of the brands respectively and contact the brand(s) directly.

9. Disclaimer

All products and company names are trademarks or registered trademarks of their respective holders. Use of them by vape stop does not imply any affiliation/association with or endorsement by them.

10. TRADEMARK AND COPYRIGHT

Vape Stop is trademarked, and has attained copyright as per the Berne Convention for the Protection of Literary and Artistic Works applicable in Bangladesh. Vape Stop is also a protected, and registered trademark in other countries. Unauthorized use of any Vape Stop trademark is a violation of trademark laws. Vape Stop design is also protected by international copyright laws. You may not copy, modify, reproduce or distribute any of the written content, design, graphics, icons, photos, or layout of the website, or individual sections of the content without prior written permission from the official Vape Stop email id with signature of authorised signatory for any public, private, or commercial purpose. Whereas, with respect to the brands or products available for sale on Vape Stop, all products and company names are trademarks or registered trademarks of their respective holders. Use of them by Vape Stop does not imply any affiliation/association with or endorsement by them. You may not frame, link or deep-link Vape Stop website to any other website. You cannot under any circumstance link our homepage or any other page to websites that are known to be used by people under 18 years of age.

11. INDEMNIFICATION

To the extent permitted by applicable law, you hereby agree to indemnify, hold harmless and defend Vape Stop and its affiliates from any and all third-party claims, actions, proceedings, and suits brought against us or any of our officers, directors, employees, agents or affiliates, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, reasonable attorneys' fees and other litigation expenses) incurred by us or any of our officers, directors, employees, agents or affiliates, arising out of or relating to your use of the website.

12. SEVERABILITY

If any provision of these terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

15. ARBITRATION

Read this Section carefully because it requires the parties to arbitrate their disputes and limits the manner in which you can seek relief from Vape Stop. For any dispute with Vape Stop, you agree to first contact us via email ([email protected]) and attempt to resolve the dispute with us informally in a time period of minimum sixty (60) days.

Class Action and Jury Trial Waiver: With respect to all persons and entities, regardless of whether they have obtained products or services provided by Vape Stop or used the website for personal, commercial or other purposes, all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class action, collective action, private attorney general action or other representative proceeding. This waiver applies to class arbitration, and, unless Vape Stop agrees otherwise, the arbitrator may not consolidate more than one person's claims.

You agree that, by entering into this agreement, you and Vape Stop are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind. Any arbitration shall be conducted in English and the place of arbitration shall be Dubai, UAE.

14. Governing Law

This Website is created to comply with laws of Bangladesh. We do not make any claim that the website is for use in locations outside Bangladesh. If you access this website from locations outside Bangladesh, you are solely responsible for complying with all applicable laws of your region/county.
